A Vereniging van Eigenaren – VvE (owners` association) is responsible for the common areas of a building and the soil it occupies and decides. Their main job is to make decisions about the maintenance and use of these common areas. Today, for apartments, it is a law to have a VVE. The building`s fire insurance is still regulated by the VVE. The information about the property and the obligations imposed on it are included in your sales contract. List all the devices included when buying the property. (z.B. refrigerator, stove, washing machine, etc.): Note that the deposit on the land is 10% of the purchase price paid six weeks after signing the sales contract. This can be replaced by a bank guarantee issued by a Dutch bank. Notaries can set their own fees. Fees are based on rates or rates (which vary depending on the sale price of the property and the amount of the financial loan) and it is sometimes possible to negotiate the notary`s fees and the percentage charged by the notary. It is advisable to contact more than one notary to compare fees.
The date of the application, that is, the date on which the buyer must verify the title and complete all other searches. It is usually set for a period of 15 days to one month before the closing date of the transaction. Before that date, it is the buyer`s responsibility to do a series of researches to ensure that there are no problems with the property. These are usually handled by the buyer`s lawyer and include things like searching the registered property with the land registry, verifying that the property complies with zonar rules, and searching for pending municipal work orders. The agreement also deals with devices and chats. Fixtures are usually improvements that have been made to a property that are connected or cannot be removed without damaging the property. Water heaters, built-in cabinets and fixtures are just a few examples of devices. It is assumed that fixtures will be included in the sale of the house, unless they are expressly excluded from the agreement. However, chattels are personal property items that are included on the land and must be explicitly mentioned in the agreement for them to be part of the sale of the house. For example, if the seller agrees to include a refrigerator, stove or gardening equipment in the sale, these items must be expressly stated in the agreement.
If there is any doubt as to whether a point should be included or excluded, it should be clearly defined in the agreement. Since all land purchase and sale agreements must be concluded in writing to be legally applicable, the agreement provides a general framework for dealing with key issues. Most local real estate councils and the Ontario Real Estate Association have established standard form agreements for buying and selling. Although these forms contain general terms and conditions, the agreement may be amended if the buyer and seller agree and if any supplements or deletions take place in the first place.
